CONTRACTING GENERAL CONDITIONS
These Contracting General Conditions, together with the specific booking conditions, govern the terms of your reservation.
Personal Data Protection
We are proud to inform you that we only collect your personal data to manage your reservation and do not use it for any commercial purposes. You will never receive any commercial communications from us or any other company, as we do not sell your data, and we are not affiliated with any other company or professional. We collect your ID/passport data to complete the traveler registration process with the National Police, which we are required to maintain as a professional accommodation provider, and it is immediately deleted from all our devices.
Minimum age to make a reservation: 18 years
Minors under 18 years of age must stay accompanied by their parents, guardians, or adults duly authorized by them. Accommodation staff may request relevant documentation identifying the adults as their parents/guardians or authorized persons.
Reservation and Payment
As indicated in the reservation process, to guarantee every reservation, you must provide a valid credit or debit card (Visa or Mastercard) or make the deposit payment in the case of a reservation at Finca Los Olivos.
These card details may be used to verify its validity, request bank pre-authorization, or charge in advance (full or partial) depending on the conditions of your reservation.
The payment method for your reservation is indicated in the reservation process and, in all cases, payment will be made only in accordance with the provisions of your reservation confirmation/rental agreement.
We comply with the European PSD2 regulation, which requires the customer to actively participate in the payment process through a double verification procedure (depending on your bank’s implementation of this regulation). Thus, depending on the characteristics of your card, your bank may request additional validation by email or SMS to process your reservation payment.
Cancellation Policy
The cancellation policy for all reservations is expressly stated in the written confirmation. For non-refundable reservations, cancellation or no-show will not result in a refund. For non-cancellable and unpaid reservations, cancellation or no-show will result in a charge to the card provided as a guarantee for the reservation. If payment cannot be made, the cardholder will be legally required to pay the amount. Once you have checked in, cancellation will be subject to the hotel’s decision.
Invalid Card
If a card provided as a means of payment and as a guarantee for the reservation does not allow the payment to be made within the time specified in the reservation confirmation, the reservation will be automatically cancelled without entitling the cardholder to any compensation.
Non-Payment or Late Payment
In the event of non-payment or late payment of any amount owed to the establishment, and without prejudice to the provisions of Articles 539, 575, and 589 of the Civil Procedure Act regarding costs and interest, the reservation holder agrees, by confirming the reservation, that the establishment may require, in addition to payment, a minimum of €250 for the cost of legal communications and the initiation of actions to exercise its right to collect the unpaid or late amount.
For these purposes, non-payment or late payment for a stay and its related costs will be considered when the establishment has not received payment or proof of payment in accordance with the specific conditions of the reservation and, in any case, upon departure of the guest and their companions from the accommodation; and in any case, when payment has not been made or proof of payment has not been provided by 12 noon on the day of departure from the accommodation specified in the reservation.
Right of Withdrawal
In accordance with consumer regulations, the right of withdrawal does not apply.
Cancellation by the establishment:
If Amelia García Hualde / HomeApartmentsJerez is forced to modify or cancel the accommodation, Amelia García Hualde / HomeApartmentsJerez will make an alternative proposal to the client. This proposal will be deemed accepted by the client unless the client responds within 48 hours of notification of the alternative presented by email or WhatsApp.
Maintenance and Emergencies
The property reserves the right to access the accommodation to carry out any necessary repairs or maintenance, trying to minimize inconvenience to the occupants as much as possible, and in all cases providing prior notice.
Breakage and/or Theft/Removal of Items
The property reserves the right to charge the card provided as a guarantee for the reservation the total amount resulting from the estimated replacement or repair of the item(s) damaged or removed/stolen by the guest at the time the breakage or absence is observed.
Waiver of Legal Jurisdiction
The parties hereto expressly waive any jurisdiction that may apply to them and submit to the jurisdiction of the Courts and Tribunals of Jerez de la Frontera.
